Terms and Conditions

1. Scope
These Terms and Conditions (hereinafter "Terms") apply to the use of the dotStorage software (hereinafter "Software"), provided by Giesswein Creativ GmbH, Sonnhangweg 41, 6314 Hopfgarten im Brixental, Austria (hereinafter "Provider"). By installing, configuring, or using the Software, the customer (hereinafter "Customer") accepts these Terms.
2. Description of Services
dotStorage is a self-hosted, distributed object storage solution with an S3-compatible API. The Software is operated on the Customer's infrastructure. The Provider supplies the Software, documentation, and optional consulting and support services.
The Software includes:
- S3-compatible API for file upload, download, and management
- Web-based management interface (Blazor UI)
- Gossip-based cluster discovery and automatic node detection
- Data replication and erasure coding for fault tolerance
- Automatic TTL management and lifecycle policies
3. License and Usage Rights
The Provider grants the Customer a non-exclusive, non-transferable right to use the Software in accordance with the agreed license terms. The license applies to the agreed number of nodes and users.
The Customer may not:
- sublicense, rent, or lend the Software to third parties;
- decompile, disassemble, or otherwise reverse-engineer the Software (except to the extent permitted by law);
- use the Software as a basis for a competing product;
- deploy the Software beyond the licensed number of nodes.
4. Self-Hosting and Responsibility
The Software is operated on the Customer's infrastructure. The Customer is responsible for:
- Provisioning and maintaining the server infrastructure (hardware, operating system, network);
- Regular backup of stored data;
- Ensuring network and access security;
- Installing and updating the Software in accordance with the documentation;
- Compliance with all applicable data protection laws for the stored data.
The Provider has no access to the Customer's infrastructure or data unless explicitly agreed upon for support purposes.
5. Support and Maintenance
Optional support and maintenance services are governed by a separate support agreement. Without a support agreement, the Provider supplies the Software "as is" and assumes no obligation to fix defects or provide updates.
Where a support agreement is in place, it typically includes:
- Access to software updates and security patches;
- Technical support via email;
- Assistance with installation and configuration.
6. Pricing and Payment
The prices individually agreed upon at the time of contract conclusion shall apply. All prices are in euros and exclusive of statutory value-added tax.
Invoices are payable within 14 days of the invoice date without deduction. In the event of late payment, the Provider reserves the right to restrict access to updates and support.
7. Liability
The Provider's liability is limited to intent and gross negligence. Liability for indirect damages, lost profits, and data loss is excluded to the extent permitted by law.
In particular, the Provider is not liable for:
- Data loss due to incorrect configuration or inadequate backups by the Customer;
- Failures of the Customer's infrastructure (hardware, network, power);
- Damage caused by unauthorized access to the Customer's infrastructure;
- Incompatibilities with third-party software or hardware.
8. Data Protection
Since the Software is operated on the Customer's infrastructure, the Customer is the data controller within the meaning of the GDPR for all data stored in dotStorage. The Provider has no access to this data.
The processing of personal data in the context of the business relationship (contact details, billing data) is carried out in accordance with the Privacy Policy.
9. Term and Termination
License agreements are concluded for the agreed term and are automatically renewed for one year at a time unless terminated with 3 months' notice before the end of the current term.
Termination must be in writing or may be sent by email to mail@software.tirol.
Upon termination, the right to use the Software expires. The Customer may export stored data via the S3 API.
10. Amendments
The Provider reserves the right to amend these Terms at any time. Changes will be communicated by email to the registered address. If the Customer does not object within 30 days, the amended Terms shall be deemed accepted.
11. Final Provisions
Austrian law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Innsbruck, Austria.
Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall not be affected.
